TERMS & CONDITIONS

1. Introductory Provisions

These Terms & Conditions ("T&C") govern the relationship between DavidCerny, s.r.o. (hereinafter "the Seller") and customers ("the Buyer") purchasing goods through the online shop at musoleum.com. By placing an order, the Buyer agrees to these T&C.

2. Order & Contract Formation

• 2.1The Buyer places an order by completing the checkout process on musoleum.com. The order constitutes a binding offer to purchase.
• 2.2The purchase contract is concluded upon the Seller's confirmation of the order sent to the Buyer's email address.
• 2.3The Seller reserves the right to cancel an order in case of stock unavailability, pricing errors, or suspected fraudulent activity. The Buyer will be notified immediately and any payment will be refunded in full.
• 2.4All orders are subject to availability. Limited edition items are sold on a first-come, first-served basis.

3. Prices & Payment

• 3.1All prices are listed in the currency shown at checkout and are final (inclusive of applicable VAT where required by law).
• 3.2The Seller accepts the following payment methods: credit/debit card, bank transfer, and other methods as listed at checkout.
• 3.3Payment is due at the time of order. Goods will not be dispatched until payment is confirmed.

4. Shipping & Delivery

• 4.1The Seller ships worldwide, including outside the European Union.
• 4.2Estimated delivery times: Czech Republic 2–5 business days, EU 5–10 business days, rest of the world 10–21 business days.
• 4.3Delivery times are estimates and may vary due to customs processing, carrier delays, or other circumstances beyond the Seller's control.
• 4.4For international orders, the Buyer may be subject to import duties, taxes, and customs fees imposed by the destination country. These charges are the sole responsibility of the Buyer.
• 4.5The Seller is not liable for delays caused by customs clearance or incorrect delivery information provided by the Buyer.

5. Right of Withdrawal (Returns)

• 5.1Consumers (non-business buyers) have the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason, in accordance with EU Directive 2011/83/EU.
• 5.2To exercise this right, notify us at eshop@musoleum.cz before the 14-day period expires, stating your order number and intent to return. You may use our sample withdrawal form, but it is not mandatory.
• 5.3Returned goods must be in original, unused condition, in original packaging where possible, and accompanied by proof of purchase.
• 5.4The Buyer bears the cost of return shipping unless the goods are defective.
• 5.5Refunds will be processed within 14 days of receiving the returned goods, using the original payment method.
• 5.6The right of withdrawal does not apply to custom-made or personalised items, goods that have been unsealed and cannot be returned for hygiene reasons, or goods that by their nature cannot be returned.

6. Defective Goods & Complaints

Complaints are governed by our separate Complaints Policy.

7. Liability

• 7.1The Seller is not liable for damage caused by incorrect use of products, force majeure, or circumstances beyond its reasonable control.
• 7.2The Seller's total liability shall not exceed the amount paid by the Buyer for the relevant order.

8. Intellectual Property

All content on musoleum.com — including images, artwork, product designs, and text — is the property of DavidCerny, s.r.o. or its licensors. Reproduction or commercial use without prior written consent is prohibited.

9. Governing Law & Disputes

• 9.1These T&C are governed by the laws of the Czech Republic.
• 9.2Any disputes shall be subject to the jurisdiction of the competent Czech courts.
• 9.3EU consumers may use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr

10. Amendments

The Seller reserves the right to update these T&C at any time. The version in effect at the time of the order applies to that order.
